These Terms of Use (“Terms”) govern your access to and use of the Burn Book mobile and web applications, related websites, and services (collectively, the “Service”) operated by the developer of Burn Book (“we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

Burn Book is not a medical device and does not provide medical, nutritional, or professional dietary advice. Nutrition values are estimates from third-party databases and may be incomplete or inaccurate. Always consult a qualified healthcare professional before making health or diet decisions. Do not disregard professional advice because of information in the Service.

4. Your account and data

Much of your data (profile settings, food log, pantry, saved recipes, and similar information) is stored locally on your device. Optional Sign in with Apple and in-app purchases may associate a subscription with an Apple identifier or RevenueCat customer record. You are responsible for maintaining the security of your device and Apple ID.

The Service relies on third parties, including Apple (Sign in, App Store, subscriptions), RevenueCat (subscription management), nutrition databases (such as USDA FoodData Central and other public sources), TheMealDB and similar recipe sources, and barcode or restaurant data providers where available. Those services have their own terms and policies. We are not responsible for third-party content, availability, or accuracy.

8. Intellectual property

The Service, including its design, branding, and original content, is owned by us or our licensors. Recipe and nutrition data may be subject to third-party licenses and attributions shown in the app. You retain ownership of content you create (e.g., custom foods or saved recipes), but grant us a limited license to process it as needed to operate the Service (for example, sending a food name to a nutrition search API).

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITION OR RECIPE DATA WILL BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

12. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms by posting a new version on this page and updating the “Last updated” date. Continued use after changes means you accept the updated Terms. Material changes may also be communicated in the app where appropriate.

13. Termination

You may stop using the Service at any time by uninstalling the app or ceasing use of the web preview. We may suspend or terminate access if you violate these Terms or if required by law or platform policies.

14. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.
